General Terms and Conditions for Passengers

Important: Please read these Terms and Conditions carefully before using the CaminoCabs app. By creating an account or using our services, you agree to be bound by these terms.
1. Introduction and Definitions
1.1 About CaminoCabs
CaminoCabs Limited ("CaminoCabs", "we", "us", or "our") operates a technology platform that connects passengers with licensed taxi drivers. We are incorporated in Ireland (Company Registration Number: 806705) with our registered address at Prospect Hill, Finglas, Dublin, Ireland.
1.2 Definitions
- "App" means the CaminoCabs mobile application available for iOS and Android devices.
- "Driver" means a licensed taxi driver who uses the CaminoCabs platform to receive ride requests.
- "Passenger" or "you" means any person who creates an account and uses the App to request Transportation Services.
- "Ride" or "Trip" means a Transportation Service provided by a Driver.
- "Platform" means the CaminoCabs App and related services.
- "Prebook" means a ride scheduled in advance for a future date and time.
- "Signal" means the CaminoCabs feature that allows passengers to broadcast their pickup request to nearby drivers.
- "Transportation Services" means all taxi transportation services and other transportation services that may be provided by an SPSV (Small Public Service Vehicle), as made available for procurement by Passengers or otherwise intermediated by CaminoCabs through the Platform.
- "Intermediation Services" means the services provided by CaminoCabs through the Platform to facilitate Transportation Services being procured by Passengers and provided by Drivers.
1.3 Our Role
When you book and/or use Transportation Services through the App, CaminoCabs acts only as an intermediary between you and the Driver and is not a party to the agreement for the provision of Transportation Services, which is instead between you and the Driver. CaminoCabs provides Intermediation Services only, that is, services facilitating Transportation Services being procured by Passengers and provided by Drivers.
CaminoCabs is not a transportation company and does not provide Transportation Services directly. Drivers are independent contractors, not employees or agents of CaminoCabs.
CaminoCabs invoices you and collects payment of the fare in the name and on behalf of the Driver, in accordance with the Driver's fare as determined by the taximeter.
2. Eligibility and Account Registration
2.1 Eligibility
To use CaminoCabs, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts
- Provide accurate and complete registration information
- Have a valid mobile phone number
2.2 Account Registration
To use our services, you must create an account by providing:
- Your full name
- A valid email address
- A valid mobile phone number
- A profile photo (optional but recommended)
2.3 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised use of your account
2.4 One Account Per Person
You may only create and maintain one passenger account. Creating multiple accounts may result in suspension or termination of all accounts.
3. Using the Service
3.1 Requesting a Ride
When you request a ride through the App:
- You will see an estimated fare based on your pickup and drop-off locations
- A nearby available Driver may accept your request
- Once accepted, you will see the Driver's name, photo, vehicle details, and estimated arrival time
- You can track the Driver's location in real-time
3.2 Fare Calculation
All taxi fares in Ireland are regulated by the National Transport Authority (NTA). Fares are calculated using a calibrated taximeter based on:
- Distance travelled
- Time spent in the taxi
- Applicable tariff (Standard, Premium, or Special Premium rates)
Tariff Times:
- Standard Rate: Monday to Saturday, 8am to 8pm
- Premium Rate: Monday to Saturday 8pm to 8am, all day Sunday, and public holidays
- Special Premium Rate: Christmas Eve (8pm) to St. Stephen's Day (8pm), New Year's Eve (8pm) to New Year's Day (8pm)
The fare shown in the App is an estimate. The actual fare is determined by the taximeter and may vary based on traffic conditions, route taken, and waiting time.
3.3 Payment Methods
You can pay for rides using:
- Card (through the App): The taxi fare is charged to your saved card. You will receive a digital receipt via email.
- Cash (to the Driver): Pay the Driver directly at the end of the trip. CaminoCabs does not issue a receipt for cash payments.
3.4 Payment Authorisation (Card Payments)
When you request a ride with card payment:
- Payment Hold: A temporary hold (pre-authorisation) is placed on your card for the estimated maximum fare. This hold reserves the funds but does not charge them immediately.
- Trip Completion: When the trip ends, the actual fare (based on the taximeter) is charged to your card.
- Hold Release: If the actual fare is less than the hold amount, the difference is automatically released back to your card. Release times depend on your bank (typically 1-7 business days).
- Additional Charge: If the actual fare exceeds the hold amount (e.g., due to route changes, traffic, or tolls), an additional charge will be made to your card for the difference.
Note: If the additional charge cannot be processed immediately, CaminoCabs will retry the payment automatically. Please ensure your payment method has sufficient funds to cover your trip.
3.5 Destination Changes During Trip
You can change your destination while the trip is in progress:
- Card Payments: An additional payment hold will be placed on your card for the estimated cost of the new route. If your card does not have sufficient funds for the additional hold, the destination change will be declined. The Driver will be notified of the new destination and the App will recalculate the route.
- Cash Payments: The destination change is processed immediately. You will pay the final taximeter amount to the Driver at the end of the trip.
3.6 Receipts
For card payments: After each completed trip, you will receive a digital receipt via email showing trip details, fare breakdown, and Driver information.
For cash payments: CaminoCabs does not issue receipts for cash payments. The Driver is legally required to offer you a printed receipt from the taximeter.
Recommendation: Always request a receipt from the Driver, especially when paying in cash. The taximeter receipt is essential for any complaints or refund requests.
3.7 How Your Payment is Processed
When you pay by card through the App:
- CaminoCabs invoices you and collects payment of the fare in the name and on behalf of the Driver, through our payment processor (Stripe).
- The Driver assigns their claim against you for payment of the fare to CaminoCabs for collection purposes.
- CaminoCabs retains its Intermediation Fee (service commission).
- The taxi fare (minus Intermediation Fee) is transferred to the Driver.
- Tips and tolls are transferred 100% to the Driver without any deduction.
For the avoidance of doubt, CaminoCabs acts as a collection agent on behalf of the Driver in respect of fare payments. This payment flow allows us to provide digital receipts, payment protection, and seamless transactions.
3.8 Obligation to Pay the Fare
Important: You are legally obliged to pay the fare shown on the taximeter at the end of each trip. This obligation applies regardless of the payment method selected in the App.
When you select cash as payment method, the fare is payable directly to the Driver at the end of the trip. CaminoCabs does not intermediate, guarantee, or assume responsibility for cash payments. Failure to pay the fare to the Driver may constitute a criminal offence under the Criminal Justice (Theft and Fraud Offences) Act 2001 ("making off without payment").
If a Driver reports non-payment of a cash fare:
- Your account may be suspended or permanently terminated
- You will not be able to use the CaminoCabs Platform until the matter is resolved
- CaminoCabs may disclose your personal data to An Garda Síochána or other law enforcement authorities upon receipt of a valid legal request, in accordance with GDPR Article 6(1)(c) (legal obligation) and Article 6(1)(f) (legitimate interest in the prevention of crime)
- CaminoCabs retains trip data (including pickup/drop-off locations, times, and account details) for the purpose of cooperating with law enforcement investigations
For the avoidance of doubt, any dispute regarding the non-payment of a cash fare is a matter between you and the Driver. CaminoCabs is not liable for any loss suffered by the Driver as a result of non-payment, but will take reasonable steps to assist in resolving such matters, including cooperating with the relevant authorities.
4. Prebooks (Scheduled Rides)
4.1 Booking in Advance
You can schedule rides in advance (Prebooks) through the App. When creating a Prebook:
- Select your pickup location, destination, and desired pickup time
- A payment hold may be placed on your card to secure the booking
- Drivers will be notified of your booking and can accept it
Important: Prebooks require card payment. Cash payment is not available for scheduled rides.
4.2 Prebook Cancellation
Free cancellation (no fee):
- At any time if no Driver has accepted your Prebook
- At any time if a Driver has accepted but has not yet activated the trip (i.e., has not started travelling to your pickup location)
- More than 30 minutes before the scheduled pickup time, even if the Driver has activated the trip
€5.50 cancellation fee applies when:
- The Driver has activated the trip (started travelling to your pickup location) and less than 30 minutes remain before the scheduled pickup time
5. Cancellation Policy
Note: Cancellation fees only apply to bookings with card payment through the App. If you selected cash payment, cancellation fees do not apply.
5.1 Immediate Rides (On-Demand) - Card Payment Only
Free cancellation:
- Before a Driver accepts your ride request
- After a Driver accepts but before they arrive at the pickup location (and has waited less than 5 minutes)
€5.50 cancellation fee applies when:
- The Driver has arrived at the pickup location and has been waiting for 5 minutes or more
- You fail to show up at the pickup location (no-show)

5.3 Payment of Cancellation Fees
Cancellation fees are charged to your saved card. They only apply when you have selected card payment for your booking. Cash bookings are not subject to cancellation fees.
6. Passenger Conduct and Responsibilities
6.1 Your Responsibilities
As a passenger, you agree to:
- Be at the pickup location at the agreed time
- Behave in a civil and orderly manner
- Wear your seatbelt during the journey
- Follow any reasonable instructions from the Driver
- Pay the fare at the end of the journey
- Treat the Driver and their vehicle with respect
6.2 Prohibited Conduct
You must not:
- Damage or soil the vehicle
- Smoke or vape in the vehicle
- Consume food or drink in the vehicle without the Driver's permission
- Behave in an abusive, threatening, or aggressive manner towards the Driver
- Request the Driver to break traffic laws or regulations
- Transport illegal substances
- Use the service for any illegal purpose
6.3 Soiling or Damage to Vehicle
In accordance with NTA regulations, if you soil or damage the vehicle to the extent that it must be taken out of service for cleaning or repair, the Driver may charge you a soiling fee of up to €140. This fee is payable directly to the Driver.
6.4 Animals
Drivers are only required to transport guide dogs and other assistance dogs. The carriage of other pets is at the Driver's discretion.
7. Rating System
7.1 Driver Ratings
After each trip, you may rate your Driver on a scale of 1 to 5 stars. Ratings help maintain service quality across the platform.
7.2 Low Ratings
If you give a Driver a rating of 2 stars or below, you will be required to provide a written explanation (minimum character requirement). Low ratings are reviewed by our administration team before being applied.
7.3 Passenger Ratings
Drivers also rate passengers after each trip. Your passenger rating is used internally to maintain safety and service quality. While you cannot see your exact rating, Drivers can see your rating and total trips completed before accepting your ride request.
Passengers with consistently low ratings (below 2 stars) may have their ride requests declined by Drivers or may have their account reviewed by CaminoCabs.
8. CaminoPoints Rewards Programme
8.1 Earning Points
You can earn CaminoPoints through:
- Completing trips paid by card – You earn points for each trip completed with card payment through the App
- Using the Signal feature
- Promotional offers
- Referrals (when available)
Note: CaminoPoints are only earned on trips paid by card through the App. Cash payments do not earn CaminoPoints. The number of points earned per trip may vary and can be changed by CaminoCabs at any time.
8.2 Using CaminoPoints - Signals
CaminoPoints can be used to access the Signal feature, which broadcasts your pickup request to nearby Partner Drivers. The Signal feature is only available for card payments.
8.3 Membership Tiers
Based on your activity, you may progress through membership tiers: Bronze, Silver, Gold, and Platinum, each offering different benefits.
8.4 Point Expiration
CaminoPoints do not expire while your account remains active.
9. CaminoCredits (Promotional Credits)
9.1 What are CaminoCredits?
CaminoCredits are promotional credits that may be earned through promotional codes, referrals, or as compensation. Credits are stored in EUR.
9.2 Usage Rules
- Credits are automatically applied to reduce your trip cost at completion
- Credits cannot reduce the fare paid to the Driver
- Credits cannot be converted to cash or transferred to another account
- Credits cannot be withdrawn or refunded
9.3 Promotional Codes
- Each promotional code may have its own expiration date and terms
- Some codes may be limited to one use per passenger
- Some codes may be restricted to specific users or first-time users
- CaminoCabs reserves the right to cancel or modify promotional codes at any time
10. Refunds and Fare Disputes
10.1 Requesting a Refund
If you believe you were charged incorrectly, you may request a refund through the Support section in the App.
10.2 Required Documentation
For any refund request related to a fare discrepancy (where you were charged a different amount than shown on the taximeter), you must provide the taximeter receipt showing:
- Date and time of the trip
- Fare amount
- Vehicle details
Important: Without the taximeter receipt, we may not be able to process refund requests for fare disputes. Always request a receipt from the Driver at the end of your trip.
10.3 Refund Processing
Valid refund requests are typically processed within 5-10 business days. Refunds are credited to the original payment method.
11. Lost Property
If you leave personal belongings in a vehicle:
- Contact us through the Support section in the App as soon as possible
- We will attempt to connect you with the Driver to arrange return of your items
- CaminoCabs does not charge a fee for lost property assistance
- The Driver may request reasonable compensation for the cost of returning your items (e.g., travel costs)
- CaminoCabs is not responsible for lost, stolen, or damaged items left in vehicles
12. Communication
12.1 In-App Communication
The App provides features to communicate with your Driver, including:
- In-app chat messaging
- In-app voice calls (VoIP)
These features protect your privacy by not revealing your personal phone number to the Driver.
12.2 Support
Customer support is available through the App. Our support team is ready to help resolve any issues quickly. Complex issues may be escalated to ensure you receive the best assistance.
12.3 Administrator Access
CaminoCabs administrators may access chat messages and support conversations for the purposes of customer support, dispute resolution, and safety investigations.
13. Account Suspension and Termination
13.1 Suspension by CaminoCabs
We may suspend or terminate your account if you:
- Violate these Terms and Conditions
- Engage in fraudulent activity
- Have a consistently low passenger rating
- Abuse or threaten Drivers
- Have outstanding unpaid fees
- Create multiple accounts
- Use the service for illegal purposes
- Fail to pay a fare to a Driver (whether by card or cash)
13.2 Outstanding Balances
If a payment cannot be processed at the time of your trip, CaminoCabs will automatically retry the charge. Your account may be temporarily restricted until the balance is resolved.
13.3 Resolving Outstanding Balances
To resolve an outstanding balance:
- Ensure you have a valid payment card with sufficient funds saved in the App
- The balance will be automatically charged when funds are available
- Once resolved, your account will be fully restored
- If you need assistance, please contact our support team through the App
13.4 Account Deletion by You
You may request deletion of your account at any time through the App (Settings → Personal Information → Delete Account), provided you have no outstanding balances. See our Privacy Notice for details on the deletion process and data retention.
14. Limitation of Liability
14.1 Intermediation Services Provider
CaminoCabs provides Intermediation Services only, facilitating connections between Passengers and Drivers through the Platform. CaminoCabs does not provide Transportation Services directly. The Transportation Services contract is between you and the Driver.
14.2 No Guarantee of Availability
We do not guarantee that a Driver will be available to accept your ride request at any given time or location.
14.3 Driver Conduct
While we require all Drivers to hold valid NTA licences and meet our standards, we are not liable for the acts or omissions of Drivers during your trip. CaminoCabs is not responsible for the behaviour, whether online or offline, of any Driver or the Transportation Services provided by them. If you have a complaint about a Driver, please report it through the App and to the NTA if appropriate.
14.4 Limitation
To the maximum extent permitted by law, CaminoCabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. In all cases, your statutory rights under applicable Irish or European consumer protection law shall be unaffected by any provision of these Terms and Conditions.
14.5 Consumer Rights
Note that the specific provision of Transportation Services to you pursuant to these Terms and Conditions constitutes a contract for passenger transport services between you and the Driver. Nothing in these Terms and Conditions limits or excludes CaminoCabs' liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any matter for which it would be illegal or unlawful to exclude or limit liability.
15. Data Protection and Law Enforcement
CaminoCabs collects and processes your personal data in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Acts 1988-2018. See our Privacy Notice for full details.
CaminoCabs may retain and disclose your personal data (including trip data, account details, pickup/drop-off locations, and payment information) to An Garda Síochána or other competent law enforcement authorities where required by law or upon receipt of a valid legal request, in accordance with GDPR Article 6(1)(c) (compliance with a legal obligation) and Article 6(1)(f) (legitimate interests, including the prevention and detection of crime). This includes, without limitation, incidents of fare evasion, fraud, threats, or other criminal activity reported by Drivers or third parties.
16. Intellectual Property
The CaminoCabs name, logo, App, and all related content are the property of CaminoCabs Limited. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our written permission.
17. Changes to These Terms
We may update these Terms and Conditions from time to time. We will notify you of significant changes by:
- Posting a notice in the App
- Sending you an email
- Updating the "Last updated" date at the top of this document
Your continued use of the App after changes are posted constitutes acceptance of the updated terms.
18. Governing Law and Disputes
18.1 Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Ireland.
18.2 Dispute Resolution
If you have a dispute with CaminoCabs, please contact us first through the App or at info@caminocabs.ie. We will attempt to resolve disputes amicably.
18.3 Online Dispute Resolution
The European Commission provides an Online Dispute Resolution platform for consumers: https://ec.europa.eu/consumers/odr
18.4 Jurisdiction
Any disputes that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Ireland.
19. Complaints About Drivers or Vehicles
Drivers and vehicles are licensed and regulated by the National Transport Authority (NTA). If you have a complaint about a Driver or vehicle that cannot be resolved through CaminoCabs, you may submit a complaint directly to the NTA:

21. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
22. Entire Agreement
These Terms and Conditions, together with our Privacy Notice and Fee Policy, constitute the entire agreement between you and CaminoCabs regarding your use of the Platform.
